  • What if I was injured while I was driving for work?
If you were driving to, from or for work and you were an employee then you will likely have a workers’ compensation claim available to you. Assuming another person was at-fault you will also be able to bring an injury claim against the CTP insurer of the at-fault vehicle. It is often (but not always) possible to pursue both claims at the same time.
  • How long do I have to lodge a claim?
You have up to three years from the date of the accident to institute proceedings in the relevant Court. It is also recommended that you lodge a claim with the CTP insurer of the driver who caused the collision within 6 months of the date of the incident.
  • What if I was partly at fault for my injuries?
To succeed in a car accident you only need to prove some other person was at fault (even if only partly). Once you do then the court considers whether you were at fault too. If so, then a finding of contributory negligence can be made. A court weighs up who was most at fault. A percentage apportionment of overall fault is made. If contributory negligence is found against you, your compensation award is reduced by the level which you are found to be at fault.
  • What about passengers of the at-fault driver?
Passengers involved in a car accident can bring claims too (it’s not restricted only to drivers). The CTP insurance of the at-fault vehicle covers the driver for any claim made by any affected party. That includes passengers in their own vehicle. Generally, making such a claim won't have any cost or adverse affects on the at-fault driver. That is a common concern when the driver is a partner, family member or friend.
  • How much compensation can I claim?
You may be entitled to various forms of compensation depending on the circumstances of your matter. The level of your compensation will depend on various factors such as the severity of your injuries and your resultant restrictions, the impact of your injuries on your work and home life, and the level of your medical expenses incurred and to be incurred in the future. Your compensation can vary widely based on a number of factors, such as the mechanism of the accident, the extent of injuries and the impact on your life. Here’s a short overview to help you understand what you might be entitled to: 1. Medical Expenses: You may be able to claim compensation for medical expenses incurred due to the accident, including hospital stays, surgeries, medications, and rehabilitation. Future medical costs, such as ongoing treatment or therapy, can also be included. 2. Lost Income: If you had to take time off work due to the accident, you may be able to claim compensation for lost wages or salary. If your injuries affect your ability to work long-term or permanently, you may be entitled to compensation for future loss of earnings. 3. Pain and Suffering: You may be able to claim compensation for the physical pain and discomfort caused by the injuries. 4. Property Damage: Compensation for the cost of repairing or replacing your vehicle if it was damaged or destroyed in the accident. If personal belongings in your vehicle were damaged or lost, you can claim for their repair or replacement. 5. Home Assistance: If your injuries require you to hire help for household chores or personal care, you may be able to claim compensation for these additional costs.
  • Who's at fault in a car accident?
There are many factors that can influence who is deemed at fault in a car or road accident. Typically, in rear end accidents between two cars, it is the car that hit the other from behind who would be deemed liable due to the responsibility to keep a safe distance. A driver is also more likely to be liable if it can be proved they made a traffic violation such as the other driver failing to stop at a give-way sign or red light, drink driving etc.
  • Do I need a lawyer for a car accident injury claim?
You can apply for compensation directly with the insurer without the need for a lawyer. However, there are a number of major drawbacks to running your own claim and avoiding legal fees generally speaking does not mean more money in your pocket. You are much more likely to achieve a higher "in pocket" amount than those choosing to represent themselves.
  • Who are road and car injury claims made against?
Motor accident claims proceed against the CTP insurer of the at-fault vehicle. Usually, the driver of the at-fault vehicle is involved only to the extent they need to tell their insurer their version of events about how the accident happened.
  • How do I make a claim?
You will need to download and complete the required claim form, and lodge the same with the relevant CTP insurer. This is a very important document in motor vehicle accident claims. Before completing the claim form, you will need various details relating to the accident, such the name of the driver who caused the accident and the police report number. It is recommended that you engage a lawyer to assist you to complete the claim form.
